Appeals court grants new trial to sexually violent predator because of prosecutorial misconduct

A convicted violent sexual predator will get a new chance for controlled release from a state hospital because of prosecutorial misconduct, a state appellate court ruled this week.

Justices on the 4th District Court of Appeal in Santa Ana on Thursday overturned a lower court decision denying the release of convicted pedophile Steven Force. The justices said Force did not receive a fair trial on his request for release because the prosecutor hinted Force might be charged with perjury if he testified in his own defense.

“We still encounter cases where a prosecutor has lost sight of the one paramount goal: fairness. That’s a failure. Acquittals are not failures. Unfair trials are,” said the ruling written by Justice William Bedsworth. “This is such a case. The prosecutor here took his eyes off the prize just long enough to commit misconduct in a way that requires reversal.”

The case was sent back to Orange County Superior Court for a new trial.

The prosecutor was not identified in the ruling, but court documents show it was veteran Deputy District Attorney Peter Finnerty.

District Attorney Todd Spitzer said Friday he is working to keep misconduct out of his office.

“Since taking office in January, I have implemented numerous reforms, including the creation of a Professional Responsibility and Training Unit, to ensure our prosecutors are continually trained and adhere to the highest legal and ethical standards,” Spitzer said.

“I have made it clear that prosecutorial misconduct will not be tolerated. This prosecution occurred under the prior administration and we are reviewing the appellate court’s opinion to determine what action, if any, is required.”

Prosecutorial misconduct at the Orange County District Attorney’s Office has drawn considerable attention since the discovery in 2014 that prosecutors and police were misusing jailhouse informants to extract confessions in violation of federal civil rights laws. Prosecutors also were holding back on sharing exculpatory evidence with defense lawyers.

The Court of Appeal was especially critical of the snitch scandal and this week repeated its admonition for prosecutors to play fair.

‘Provide a fair trial’

“When you get right down to it, that’s the whole job of the trial prosecutor: Provide a fair trial,” said the ruling. “Enforcing the law, protecting the public, supporting crime victims, any phraseology you choose for other aspects of criminal prosecution are subsets of that one job. It’s not about convictions, it’s not about courtroom mastery, it’s not about prison sentences. And it’s certainly not about won/lost records. It’s about fair trials.”

According to the ruling, Force was sexually abused as a child and then began committing sex crimes as a teenager. He was committed to Patton State Hospital in San Bernardino County for two years at age 21 after exposing himself and sexually assaulting a girl on a playground. In 1985, a few years after his release, he again assaulted an 8-year-old girl in an elevator and served three years in state prison.

After his parole, Force got married, but molested his wife’s relatives and was sentenced to 20 years in prison. He served half that time and was transferred indefinitely as a sexually violent predator to Coalinga State Hospital. At the hospital, he exposed himself to a nurse in 2010. He applied for the conditional release program in 2015 and again in 2017.

Under the conditional release program, offenders receive treatment and supervision. During his previous release trial, Force denied some of his sexual offenses, according to the appellate ruling. However, he admitted to those crimes as part of his hospital treatment and planned to do so again during his latest trial.

But, according to the appellate ruling, the prosecutor told Force’s attorney that he could be charged with perjury. That comment was reported to the judge, who was concerned to the point of saying the prosecutor “might be working in a flower shop next week.”

Justices Bedsworth, Richard Aronson and David Thompson ruled the case should be retried and the court should ensure that Force’s constitutional rights are not violated. Medical experts testified in his latest trial that he was a good risk for the supervised release program.

Elementary Students Receive Backpacks Filled With Supplies To Start School Year Off Right

LONG BEACH (CBSLA) — Students at Signal Hill Elementary School received a surprise Thursday to help them start the new school year right.

More than 700 backpacks filled with school supplies were handed out to excited students.

Office Depot made the donations as part of its “Start Proud” program.

The backpacks were full of everything from pencils to paper, and a $20 gift certificate to buy other items, something the school’s principal says can make all the difference.

“Sometimes it can be the tangible things, the school supplies. And when we can equip them with those supplies,  to go along with all those other ways to help start the year right, that’s what leads to a really successful year,” said Signal Hill Elementary School’s principal Scott Tardibuono.

Several pallets of classroom supplies were also given to teachers.

Valerie Harper, TV’s Rhoda, has died at 80

LOS ANGELES (AP) — Valerie Harper, who scored guffaws, stole hearts and busted TV taboos as the brash, self-deprecating Rhoda Morgenstern on back-to-back hit sitcoms in the 1970s, has died.

Longtime family friend Dan Watt confirmed Harper died Friday, adding the family wasn’t immediately releasing any further details. She had been battling cancer for years, and her husband said recently he had been advised to put her in hospice care.

Harper was a breakout star on “The Mary Tyler Moore Show,” then the lead of her own series, “Rhoda.” She was 80.

She won three consecutive Emmys (1971-73) as supporting actress on “The Mary Tyler Moore Show” and another for outstanding lead actress for “Rhoda,” which ran from 1974-78. Beyond awards, she was immortalized — and typecast — for playing one of television’s most beloved characters, a best friend the equal of Ethel Mertz and Ed Norton in TV’s sidekick pantheon.

Fans had long feared the news of her passing. In 2013, she first revealed that she had been diagnosed with brain cancer and had been told by her doctors she had as little as three months to live. Some responded as if a family member were in peril.

But she refused to despair. “I’m not dying until I do,” Harper said in an interview on NBC’s “Today” show. “I promise I won’t.” Harper did outlive her famous co-star: Mary Tyler Moore died in January 2017. Ed Asner, Cloris Leachman and Betty White are among the former cast members who survive her.

In recent years, Harper’s other appearances included “American Dad!” ”The Simpsons” and “Two Broke Girls.”

Harper was a chorus dancer on Broadway as a teen before moving into comedy and improv when, in 1970, she auditioned for the part of a Bronx-born Jewish girl who would be a neighbor and pal of Minneapolis news producer Mary Richards on a new sitcom for CBS.

It seemed a long shot for the young, unknown actress. As she recalled, “I’m not Jewish, not from New York, and I have a small shiksa nose.” And she had almost no TV experience.

But Harper, who arrived for her audition some 20 pounds overweight, may have clinched the role when she blurted out in admiration to the show’s tall, slender star: “Look at you in white pants without a long jacket to cover your behind!”

LOS ANGELES (CBSLA) — Actress Valerie Harper died on Friday at the age of 80, her family confirmed.

Harper, best known for her role as acerbic Rhoda Morgenstern in “The Mary Tyler Moore Show” and spinoff “Rhoda” was diagnosed with lung cancer in 2009.

Born in Suffern, New York, Harper began her career as a dancer on Broadway before landing her breakthrough role in 1970 when she joined the cast of “The Mary Tyler Moore Show” as Mary’s best friend and neighbor.

She received the Emmy for outstanding supporting actress in a comedy three times for her work on the “The Mary Tyler Moore Show.”

Her beloved role led to a spin-off series Rhoda in which she also received an Emmy — this time as a lead actress.

On “Mary Tyler Moore,” the Rhoda character complained about not being able to find a good man and her weight. The writers of “Rhoda” capitalized on Harper’s real-life weight loss, moved her to New York and she quickly fell in love with Joe, a construction foreman played by David Groh.

“Rhoda’s Wedding” won the sitcom big ratings but the writers soon found out the audience liked Rhoda single and complaining about men and in a rare move for the time had her divorce Joe.

Later in her acting career, Harper returned to the stage, appearing in several Broadway productions including a Tony nomination for her performance as gravely-voiced diva Talullah Bankhead. She also guest-starred on many programs, dramas and comedies both including “Mrlose Place,” “Desperate Housewives,” “Hot in Cleveland,” “Sex and the City,” and “2 Broke Girls” to name a few.

In 1986, she starred in NBC’s  “Valerie’s Family” but was fired from the show after two seasons following a salary dispute. The show’s title became “The Hogan Family.”

She and Moore also revisited their sitcom roles in a TV movie that looked at where the characters were decades later.

Harper was first diagnosed with lung cancer in 2009. In 2013, she announced that she was also diagnosed with an aggressive brain tumor. She was given three months to live.

Harper is survived by her husband, Tony Cacciotti and their daughter, Cristina.

LOS ANGELES (CBSLA) — Electric scooters are a popular mode of transportation for people in Los Angeles.

However, many forget the potential dangers that come along with riding them.

A new study has found that a common factor behind electric scooter accidents is alcohol.

Almost all of the riders involved in the accident study were not wearing helmets.

According to researchers, this is one of the first studies looking at who is most at risk of getting hurt while riding an e-scooter.

The study was published in the journal of the American Association for the Surgery of Trauma.

Angels Pitcher Tyler Skaggs Died Of Alcohol, Fentanyl, Oxycodone Mix

LOS ANGELES (CBSLA) – A toxicology report has determined that 27-year-old Los Angeles Angels pitcher Tyler Skaggs died in Texas of an accidental overdose from a mix of alcohol, fentanyl and oxycodone last month.

On the afternoon of July 1, Skaggs was found dead in his hotel room in the Dallas area suburb of Southlake. At the time, police ruled out both foul play and suicide. The Angels were in Dallas for a three-game series against the Rangers.

The toxicology report released Friday by the Tarrant County Medical Examiner and obtained by CBS2 determined he had a cocktail of drugs in his system including ethanol, fentanyl and oxycodone. The manner of death was ruled an accident.

The Southlake Police Department issued a statement Friday confirming that is continuing its investigation into Skaggs’ death.

A statement released by the Skaggs family Friday claimed that an Angels employee may have been involved in the death:

“We were shocked to learn that it may involve an employee of the Los Angeles Angels,” the statement read in part. “We will not rest until we learn the truth about how Tyler came into possession of these narcotics, including who supplied them.”

The Angels provided CBS2 with the following statement, but did not reference the Skaggs family’s allegations.

“Tyler was and always will be a beloved member of the Angels Family and we are deeply saddened to learn what caused this tragic death,” the team wrote. “Angels Baseball has provided our full cooperation and assistance to the Southlake Police as they conduct their investigation.”

Skaggs, who attended Santa Monica High School where his mother is a softball coach, was drafted by the Angels back in 2009. He was traded to the Arizona Diamondbacks in 2010, but was then traded back to the Angels in 2013, and had been with the Angels ever since. He was recently married to his wife Carli during this past offseason.

Skaggs underwent Tommy John surgery that kept him out of action during the 2015 season. He had a career record of 28-38 with a 7-7 record this season.

“We are heartbroken to learn that the passing of our beloved Tyler was the result of a combination of dangerous drugs and alcohol. That is completely out of character for someone who worked so hard to become a Major League baseball player and had a very promising future in the game he loved so much.

“We are grateful for the work of the detectives in the Southlake Police Department and their ongoing investigation into the circumstances surrounding Tyler’s death. We were shocked to learn that it may involve an employee of the Los Angeles Angels. We will not rest until we learn the truth about how Tyler came into possession of these narcotics, including who supplied them. To that end, we have hired Texas attorney Rusty Hardin to assist us.”

Two-Alarm Brush Fire Erupts In Malibu, Burns 40 Acres

MALIBU (CBSLA) — A two-alarm brush fire erupted in Malibu Friday morning.

The Sweetwater Fire, which was first reported at about 11:30 a.m. in the area of Pacific Coast Highway and Sweetwater Canyon Road, quickly scorched five acres, but appears to be creeping uphill, according to the Los Angeles County Fire Department.

Just before 1 p.m., the L.A. County Fire Department announced on Twitter that the fire had spread to ten acres and that it was holding at the ridgeline.

It was later reported that the fire had burned up to 40 acres and was 20% contained and that forward progress had stopped.

Just before 2 p.m., L.A. County Fire reported the fire to be 60% contained.

There were no immediate reports of injuries or evacuations. No homes were threatened. As of noon, the weather was cooperating with firefighters.

“The conditions are actually quite favorable…with the winds right now they don’t seem to be making too much of an impact on this fire so everything seems to be under control,” L.A. County Fire Inspector Sky Cornell told CBS2.

Cornell estimated that crews would be able to keep the fire under 25 acres.

There were four water-dropping helicopters assisting ground crews in the firefight, Cornell said. Fixed-wing tankers were also brought in to dump fire retardant on the flames. At least 200 firefighters were on the scene, not including the air operations.

Forecasters had warned of elevated fire danger throughout the weekend due to hot and dry conditions exacerbated by gusty afternoon winds. Sunday is expected to be the warmest day.

Malibu was most recently hit by the Woolsey Fire in November of last year, the largest fire to ever hit the Santa Monica Mountains National Recreation Area.

The 97,000-acre fire broke out south of Simi Valley, then jumped the south side of the 101 Freeway near Calabasas and spread into Malibu.

The fire destroyed more than 1,500 structures and was responsible for three deaths.

2 Men Found Dead On Torrance Beach

TORRANCE (CBSLA) – The bodies of two men were found on Torrance Beach in the city of Torrance Friday morning.

The two bodies were found in the sand at around 7 a.m., according to Torrance police. Footage taken from Sky2 showed the bodies in the 400 block of Paseo de La Playa.

The identities of the victims were not known, police said. There was no word on a possible cause of death. Police later called the case an isolated incident and said there is no threat to the community.

The beach area around where the bodies were found was shut down for several hours, but was fully reopened at around 1:30 p.m.

The LA County Fair opened Friday at noon at the Fairplex in Pomona. This year’s theme is “Fair Goes Pop!” celebrating Los Angeles’ influence on pop culture.

Fair officials say they are also focused on value this year, by holding admission prices down to last year’s levels and adding to its popular $6.50 menu, which includes classics like funnel cakes, corn dogs, pizza and BBQ plus a few fair favorites like hatch green chile asada fries, deep-fried pineapple and Tajin Dole Whip. New this year to the value menu is one of fried food connoisseur Chicken Charlie’s creations – a deep fried peanut butter and jelly sandwich slathered with strawberry jelly, dusted with powdered sugar and topped with fruity pebbles.

On weekends and holidays, including Labor Day, admission is $20 for adults, $15 for seniors, and $12 for children. Kids 5 and under are free. Admission does not include parking, which starts at $15 for general parking. There are several discount opportunities, including resident discount days and deeply discounted tickets for active and retired military, veterans and first responders; discounts for college students, and free admission on certain Wednesdays in anyone donating school supplies.

What is No MSG Added?

We had our first show in May. The idea to create an Asian American sketch group came from our head writer, Eric Vue. There’s a niche that needs to be filled in O.C. for sketch comedy. Like many minority or marginalized communities, we felt it would be a way of being seen and heard. And we were hoping to capitalize on the success of the film “Crazy Rich Asians.”

What’s your role?

I’m the director, though I also perform in some sketches. There are about 10 of us—actors, writers, or both. My job is to make sure everything is funny and organized. I take actors’ choices and tweak them so the jokes land a little harder.

Do you have a background in directing?

I got my degree in drama. After I graduated in 2016, I got the opportunity to direct my first show at the Long Beach Playhouse, and I realized I was more suited to looking at a scene from the outside.

Are the sketches related to the Asian American experience?

We told the writers: We’re giving you a vehicle to write whatever you want, whether it’s about the Asian American experience or not. Because even if you’re not writing specifically about that, what you write will be colored by the fact that you are Asian American. That doesn’t mean the audience has to be Asian American to relate to it. I think people are starting to understand that there’s an untapped source of stories from other cultures that have been ignored. At the same time, people of color are starting to understand their worth and refuse to stay silent.

Whittier Paralegal Arrested For Stealing $181K From Clients At Immigration Law Firms

WHITTIER (CBSLA) – A 40-year-old woman was arrested Thursday on federal charges alleging she stole tens of thousands of dollars from clients of several immigration law firms where she worked in Los Angeles and Riverside counties.

Tanya Garcia of Whittier was arrested by federal authorities at her home on six counts of wire fraud and one count of aggravated theft. Federal prosecutors allege that theft of $181,344 occurred between October 2014 and October 2018.

According to the indictment, she would collect check payments from clients at her immigration law firms, but ask them to leave the “pay to” line blank.

She would then write in her own name and deposit the checks into her own bank account, which she used to pay her mortgage, credit card bills and buy clothes.

Furthermore, for check payments intended for the federal government, Garcia would go as far as to cross out the “U.S. Department of Homeland Security” from the pay to line and write in her own name, prosecutors say.

Then, when those clients who had been defrauded realized they weren’t receiving legal services, Garcia would refuse to let them speak to their lawyers, the federal indictment claims.

Garcia faces a maximum sentence of 62 years in prison if convicted as charged.

If convicted of all charges, Garcia would face a statutory maximum sentence of 62 years in federal prison.

Drivers Are Most Likely To Get Parking Tickets In These LA Neighborhoods

LOS ANGELES (CBSLA) — Parking tickets are an all-too-common occurrence in the city of Los Angeles.

The top three reasons drivers are receiving tickets are street cleaning, expired meters, and parking in red zones.

According to the City Controller’s Office, parking fines were expected to have brought in about $140 million of the city’s nearly $10 billion budget recently.

Most of the tickets were said to be distributed in the following areas:

  • Downtown L.A.
  • Hollywood
  • Westlake District
  • Sawtelle
  • Venice

Edgar Pelaez works for Meals on Wheels delivering food to seniors and says his job involves driving to some of the parking ticket hot spots in Los Angeles.

“For the simplest things, we get tickets,” said Pelaez.

According to data from L.A. City Hall and the Department of Transportation, citations have dipped about 13% during the first seven months of this year compared with the same time in 2018.

“They’re fast. The moment your meter goes off.  They’re there and they’re making sure they’re ticketing you,” said Koreatown resident Megan Miller.

Parking tickets also serve a public purpose by keeping spots clear for first responders.

“Every place is designated for either an ambulance, or pick-up, or drop-off. There’s not enough parking places around here,” Downtown resident Jonathan Biagini said.

Pelaez says Meals on Wheels runs two-person teams as a way to avoid citations.

“Usually if we can’t find parking, one of us has to stay and watch for officers and if they come by we have to move, drive around,  wait for the guy to come back.”

When it comes to parking tickets, even non-profits are not afforded any charity.

Fontana Man Accused Of Trying To Make Date With 10-Year-Old Girl, Possessing Child Porn

FONTANA (CBSLA)  — Authorities have arrested a Fontana man they said tried to have a sexual encounter with a girl he allegedly knew was 10-years-of age.

Detectives with the Fontana Police Department Internet Crimes Against Children (ICAC) Task Force also said the man also possessed child pornography.

The suspect has been identified as 32-year-old Rene Gabriel Lamadrid. He was arrested at his parents’ home in Colton.

Officials said Lamadrid met the 10-year-old through the app Likee and on Snapchat.  Lamadrid used the screen name JackSawyer311 on Snapchat.

“One of the family members had seen something on the daughter’s Snapchat, realized that it was adult material,” says Fontana Police Officer Rich Guerrero.

In addition to trying to meet the potential victim, officials said Lamadrid also sent videos to the girl of himself performing sexual acts and pleasuring himself via cellphone.

Authorities said he also attempted to have the girl send him videos of herself.

Officials told CBS2/KCAL9 reporter Nicole Comstock they believe there are many victims that Lamadrid came in contact with and more they don’t know about.

They believe he has been  communicating with young girls through various cellphone apps including Skout, Kick and Whisper.

“It’s scary,” says Officer Guerrero. And he told parents to look out for the screen name JackSawyer311.

“Parents, just please check your children’s phones,” Guerrero says.

Lamadrid was booked at the West Valley Detention Center for contact or communication with a minor to commit offense, unnatural or abnormal sexual interest in children and possession of child pornography.

LOS ANGELES (CBSLA) — Travelers flying home to Florida from LAX Thursday night worried about what’s in store for them as Hurricane Dorian bears down on the state.

“If they say evacuate, we’re out,” said passenger Jay Nelson.

“We’re definitely going to get some rain but I’m hoping that it stays off Miami and we’re okay,” passenger Lindsay Nelson said, “We’ll kind of hunker down and hang out if it’s too much rain and have a good time inside instead.”

Thousand Oaks resident Sue Engler has volunteered with the Red Cross’ disaster relief efforts since 2008 and is preparing to help out.

“I was contacted by the national headquarters for the American Red Cross to be ready to go well enough in advance of when recovery needs to be planned,” Engler said.

The National Weather Service said Dorian could be a triple threat, bringing life threatening storm surge, devastating winds, and heavy rain. It could come ashore anywhere from southern Florida to the Georgia border, bringing with it 100 mile per hour wind gusts.

The governors of Florida and Georgia have already declared a state of emergency. Florida’s governor has activated more than 2,500 national guard troops and local mayors are begging people to be prepared.

”You need to have three days of food. You need to have three days’ worth of water. As much as possible try to be self-sufficient,” Miami-Dade Mayor Carlos Giménez warned residents.

Officials say they’re learning from the past; Hurricane Irma hit Florida hard two years ago.

West Palm Beach Mayor Keith James says they’re already sending teams to nursing homes to make sure they have generators and supplies: “We don’t want a repeat of some of the horror stories I’m sure you heard from other communities in 2017, where folks literally died from heat exposure.”

And the timing of this storm — Labor Day Weekend — is bad for local businesses, which rely heavily on tourist dollars. Visitors in Cocoa Beach are already canceling hotel reservations and cruise ships and flights are being re-routed as well.

So far officials in Florida haven’t ordered evacuations. President Trump has been briefed on the storm and canceled a trip to Poland ahead of Dorian’s arrival.

Car Overturns After Striking Light Pole, Fire Hydrant Following Pico Rivera Crash

PICO RIVERA (CBSLA) — A Thursday night accident in Pico Rivera took out a light pole and struck a fire hydrant, causing a geyser of water to flow into the street.

According to police, the three-car accident happened just after 9 p.m. at the intersection of East Whittier and Rosemead boulevards. Police said a woman driving a 2011 Toyota Corolla headed southbound on Rosemead Boulevard ran a red light and crashed into two vehicles that were traveling westbound on Whittier Boulevard.

The Corolla then flipped a few times before striking a vehicle that was coming out of the Target parking lot. The vehicle then struck a light pole and a fire hydrant — unleashing a geyser of water — before coming to a stop on the roof with the driver trapped in the vehicle.

Firefighters were able to extricate the woman from the vehicle. She was taken to the hospital and was said to be in stable condition with non-life threatening injuries.

The drivers and passengers of the other vehicles involved in the accident were said to be in stable condition, also with non-life threatening injuries.

Health Officials Sound Alarm On Potential Dangers Of Vaping

LOS ANGELES (CBSLA) — Health officials in California and other states are sounding the alarm about vaping after multiple people have ended up in the emergency room with vaping-related illnesses — like lung damage.

Those same officials said they are trying to get the word out that dozens of serious lung injuries have been reported across the state, injuries that they believed to be caused by vaping.

Ventura County’s health department just referred two cases to the state that they believe could be vape-related severe respiratory disease.

“Certainly there is short-term lung damage that’s been reported to be associated with vaping,” Robert Levin, Ventura County public health officer, said.

Across California, 38 potential cases of acute lung disease among people with a recent history of vaping have been identified since late June. Health officials said whether the user is vaping tobacco products or marijuana, potential dangers exist.

“We have no idea what kind of chemicals that these flavorants turn into when they’re ignited in a vaping device,” Levin said.

The state launched a new marketing campaign that spotlights the dangerous side effects of nicotine. The ads are just one part of a campaign targeting teens. According to recent surveys, e-cigarette use among teens is growing.

The Federal Trade Commission is also stepping in. The commission is reportedly investigating Juul Labs, the company that dominates the e-cigarette market. CEO Kevin Burns spoke with CBS about the widespread use of Juul e-cigarettes by young people.

“I think the problem is big,” he said. “It’s big, and concerning and needs to be a lot lower than it is today.”

The state is also warning of dangers for customers who buy vaping devices from pop-up stores, or from unlicensed marijuana dispensaries.

SAN PEDRO (CBSLA) — A woman is in grave condition with severe head trauma after falling 70 feet from a cliff in San Pedro.

It’s not known what caused the woman to plunge from the ocean bluff down to the rocky beach below.

Firefighters hoisted her into an LAFD helicopter and gave her medical attention en route to a local trauma center.

The woman, who is approximately 50 years old, was conscious but unable to move when rescue personnel arrived.

2 West Nile Virus Cases Confirmed In Riverside County

RIVERSIDE (CBSLA) — Health officials confirmed two cases of West Nile virus in Riverside County on Thursday.

A 65-year-old Mecca woman and a 71-year-old Coachella man were admitted to hospitals for treatment in recent weeks, according to the county Department of Public Health.

No other details were reported but the patients were said to be expected to recover.

West Nile is transmitted to people and animals through the bite of an infected mosquito. Last week, the Greater Los Angeles County Vector Control District reported finding mosquitoes in Bellflower that tested positive for the virus.

Virus-positive mosquitoes were found in Long Beach earlier in July, and in Los Angeles at the beginning of August.

“Mosquito bites aren’t just annoying, they may make you sick. So everyone should take protective action by using mosquito repellent when outdoors and getting rid of items in their homes or yards that collect standing water where mosquitoes can breed,” Dr. Muntu Davis, Los Angeles County’s health officer, said in a statement.

According to the department, symptoms from contracting West Nile can include fever, headache, body aches, nausea, or skin rash and can last for several days to months.

Health officials offered tips to reduce mosquito habitats including eliminating standing water, making sure swimming pools are properly maintained, and changing the water in pet dishes and birdbaths weekly.

Officials urged the public to report stagnant swimming pools or “green pools” to the Public Health Environmental Health Bureau at (626) 430-5200, or to a local vector control agency.

NEW VIDEO: Verbal Abuse, Thrown Items Preceded Hollywood Car Ramming Incident

LOS ANGELES (CBSLA) — The lawyer for the woman who rammed a Mustang with her Mercedes near a Hollywood taco truck Sunday claims new video shows she might have been provoked before it occurred.

People surrounding the rammed car are shown on the new footage being verbally abusive and throwing an item at the woman, who has been identified as 24-year-old Amber Rose Darbinyan.

“It’s not until we have all the facts, all the videos, all the dialogue that we can say [what provoked it.] It’s a piece of the puzzle,” says Darbinyan’s attorney, Jose Romero.

Romero also says his client is often singled out because of her roles in Armenian television: “Apparently she’s cast as the villain and has had numerous confrontations on the street with people with who believe she’s that character.”

He’s not saying that’s what necessarily happened in Hollywood, however.

The incident happened around 3 a.m. Sunday when Darbinyan tried to leave the area by the taco truck. Security video showed her talking with the group of people behind her vehicle.

The confrontation escalated as plates and food begin flying and others in the group can be seen holding people back.

The group does not move, and Darbinyan can be seen in her vehicle ramming into the Mustang behind her multiple times until that vehicle is in the middle of traffic, and she is able to exit the parking lot. The video shows her almost hitting people in the process.

“We were like, ‘Wow, this is crazy,’” Juan Munoz, co-owner of Sugar Coat Innovations, said. “We’ve never seen anything that that happen in our parking lot at all.”

Darbinyan allegedly streamed a high speed chase on Instagram in 2018.

Romero says he’s been in touch with detectives and that Darbinyan has not been interrogated.

LAPD tells CBSLA that they are still gathering information.

‘He Was Simply Standing There’: Attorneys Announce Lawsuit Against Chino PD After Fatal Shooting

CHINO (CBSLA) — The attorneys for the family of an unarmed man fatally shot by a Chino police officer during a drug raid last month announced they are filing suit against the Chino Police Department.

The shooting happened July 3 when a special enforcement team was serving a search warrant at a home on Rockrose Street for drug trafficking and cultivation. When police knocked on the door, a woman walked out with her hands up. Police later found 49-year-old Li Xi Wang behind a door. Video captured on an officer’s body camera showed an officer yelled a command before shooting Wang, who later died from his injuries.

“He was just standing there,” attorney Brian Dunn said. “What could Mr. Wang have done to keep from being killed after that officer found him?”

The family of the single father and Chinese immigrant has hired prominent civil rights attorneys at The Cochran Firm. Attorneys said in a Wednesday news conference that they have filed a claim for damages which they said would lead to a federal civil rights and wrongful death lawsuit.

According to the attorneys, Wang immigrated to the United States in 2005 working odd jobs to support his son as a single father. He eventually took a job at the illegal grow house.

“He’s not a drug dealer,” attorney Daniel Deng said. “He’s not a smuggler. He’s just a simple worker trying to make a living by taking care of marijuana.”

Police said Wang and the woman arrested were running another grow house in Fontana. In all, detectives seized nearly 1,500 marijuana plants, $35,000 in cash and found evidence of grand theft worth more than $105,000, but Deng said that money was Wong’s life savings.

“Why did this shooting happened,” Dunn said. “What caused it?”

Chino police have not responded to the claim.

The San Bernardino Sheriff’s Department is investigating and will send their findings to the district attorney’s office. The Chino Police Department is also conducting an internal investigation.

LOS ANGELES (CBSLA) — It turns out “Jabba the Hutt” isn’t the only one concerned about “thermal detonators.”

The Transportation Security Administration is banning a popular souvenir Coke bottle from Disney’s “Star Wars: Galaxy’s Edge” park that looks just like that explosive from a “galaxy far, far away.”

Passengers will not be permitted to carry the $5 thermal detonator-shaped bottles in carry-on or checked baggage.

The policy came to light when a traveler asked TSA via Twitter if the “Star Wars”-themed bottle could be packed in a suitcase.

Pursuit Suspects Lead Deputies On Wild Chase, Share Romantic Moment In Bell Gardens Backyard

BELL GARDENS (CBSLA) — Two robbery suspects led sheriff’s deputies on a wild pursuit through the streets of East LA, Commerce, and Bell Gardens Wednesday afternoon, and shared a romantic moment before surrendering.

During the pursuit, the driver went the wrong way up streets, weaved in and out of lanes and narrowly avoided a crash.

The duo even came close to pushing a pick up truck out of their way in Bell Gardens.

The car eventually stopped in an alley near Fostoria Street and Eastern Avenue.

The female driver and her male passenger got out of the car and ran.  At one point the woman was leaping from one rooftop to another.

She even ran along the tops of walls before eventually joining the male suspect on the roof of a backyard shed.

And then, in true “Bonnie and Clyde” fashion, the duo engaged in a romantic embrace before deciding to surrender to the pursuing officers.

The suspects were then taken into custody without incident.

Hearing Begins For Man Charged In Deadly Silver Lake Trader Joe’s Standoff

LOS ANGELES (CBSLA) – More than a year after the Silver Lake Trader Joe’s shooting and standoff, some of the hostages recounted the terrifying day in a preliminary hearing.

The hearing began Wednesday to determine if 29-year-old Gene Evin Atkins will have to stand trial on multiple charges after a Trader Joe’s assistant manager was fatally shot when gunbattle broke out after a police pursuit ended with a standoff inside the store.

Gene Evin Atkins was charged with 51 different counts, including the slaying of 27-year-old Melyda Maricela Corado on July 21, 2018.

Atkins was accused of kidnapping his teen girlfriend and forcing her into his grandmother’s car, which he crashed into a light pole in front of Trader Joe’s at the end of a police pursuit.

He then fled inside of the market while exchanging gunfire with pursuing officers.

An over three-hour standoff ensued between police and Atkins, as he held people hostage inside the store.

Several store employees and customers were able to escape from the store, while others were released by Atkins at various times before he surrendered.

Victims held hostage in Trader Joes gave gut-wrenching testimony Wednesday reliving the three terrifying hours on that afternoon in July.

One witness, a young woman, could be seen in the store security camera holding her hands up.

She described the moment the gunman, identified by witnesses and others as  Atkins, ordered a store employee to pick out one of the hostages.

“I assumed he was picking somebody to shoot,” the unidentified female victim said.

She testified that Atkins was standing, gun in hand, behind the computer.

“The gunman was on phone with police and at one point we looked up and there was sharpshooter across the street…he demanded that if the sharpshooter didn’t leave in five seconds he was going to count down from five and we’re going to be dragged out in body bags,” she said.

She then described that Atkins was looking directly at her while he counted down from five.

“I made eye contact with him….he stopped because the sharpshooter left the scene,” she recalled.

The next witness, a man in his thirties, testified he heard a crash, ran into a sliding glass door in front of the store and said he saw Atkins jump out of a car.

“He pulled out a gun and started shooting at the cops,” said the unidentified male witness.

Corado was shot by police in front of the store and managed to stumble back inside, collapsing behind the manager’s station.

The witness testified he noticed Corado bleeding on the floor behind the counter.

“I went over there to jiggle her to see is she was alive,” he said.

He said he couldn’t feel a pulse and he and an employee carried her out, but paramedics were unable to save her.

Though Atkins did not shoot Corado, he was charged with her killing under the theory that he set off the chain of events that led to Corado’s death.

At a court hearing last December, Atkins told the judge that he has no criminal record, but has an “extensive mental health record” that includes a diagnosis of “bipolar disorder and a list of other disorders, as well.”

Atkins unsuccessfully tried to plead insanity at that hearing and in February, told a judge that he was a prophet “sent here by Jesus” and didn’t understand anything.

After acting as his own lawyer, Atkins was appointed an attorney.

He is charged with 51 counts, including murder, attempted murder and false imprisonment of a hostage.

LOS ANGELES (CBSLA) — A coyote with a doggie chew toy apparently lodged in its jaws has been spotted wandering the Silver Lake area of Los Angeles.

Neighbors tell CBSLA they’ve seen the coyote in distress roaming the neighborhood over the past week.

One video appears to show the coyote with what someone described as a red Kong toy lodged in its bottom as the animal attempts to drink from a water fountain.

Neighbors say they have alerted authorities and animal rescue groups, but so far no one has been successful in safely trapping the animal.

Homeless Man Dies Of Burn Injuries After Skid Row Tent Is Set On Fire; Suspect In Custody

LOS ANGELES (CBSLA) — A Los Angeles man was charged Wednesday with capital murder for allegedly setting a tent ablaze on skid row, killing a homeless man.

Jonathan Early, 38, was arrested near where a tent was found on fire at about 11:30 p.m. Monday in the area of 6th and San Pedro streets, Los Angeles police spokesman Officer Mike Lopez said.

The victim was identified by the District Attorney’s Office as Dwayne Fields, 62, but the Los Angeles Community Action Network — a group working to combat
homelessness and provide services for the poor — said his name was Darrell Fields, a long-time skid row resident.

Fields was taken to a hospital, where he died of burn injuries after he was found in the burning tent.

Early was booked on suspicion of murder and is being held on $2 million bail.

According to the Los Angeles County District Attorney’s Office, the murder charge includes the special circumstance allegation of murder involving the infliction of torture.

Early was scheduled to be arraigned Wednesday afternoon in a downtown Los Angeles courtroom but a judge delayed the hearing until Sept. 25.

Police did not immediately disclose a motive for the attack, which remained under investigation by the Los Angeles Police Department’s Robbery-Homicide Division and the Los Angeles City Fire Department’s Arson/Counter-Terrorism Section.

LOS ANGELES (CBSLA) — Southern Californians enjoying the warm summer nights are contending with some uninvited guests – a bigger influx of mosquitos, including a breed new to the region.

Noticing more red, itchy bites to the legs and arms than usual? You’re not alone. Health officials say this year’s mosquito activity is worse than usual.

“No matter what I put on, it’s just like – I get bitten everywhere,” said Delilah Gutierrez as she walked with her family in Balboa Park.

Last winter’s record rainfall is one big reason for the influx, but there are other factors, including new breeds joining the native mosquito known for carrying West Nile Virus.

“We have new kinds of mosquitoes in Southern California” in addition to the region’s native breeds, said Alais Medina-Diaz of the Greater Los Angeles County Vector Control. “But now we also have the invasive Aedes mosquitoes, and that one bites during the day and it primarily bites humans.”

Clearing standing water should help keep mosquitoes away, and spray repellents should have ingredients recommended by the CDC and the EPA.

Council Adopts Resolution Opposing Bill That Would Extend Bar Hours

LOS ANGELES (CBSLA) — The Los Angeles City Council passed a resolution Tuesday opposing a bill pending in the state legislature that would allow bars in Los Angeles — and nine other cities — to remain open until 4 a.m.

The bill, SB 58, introduced by Sen. Scott Wiener, D-San Francisco, would create a five-year pilot program beginning in 2022 that would allow bars to remain open until 4 a.m. in Cathedral City, Coachella, Long Beach, Los Angeles, Oakland, Palm Springs, Sacramento, Fresno, San Francisco and West Hollywood. Existing law prohibits the sale of alcohol from 2 to 6 a.m.

Wiener has proposed the 4 a.m. last call bill three times. One of his previous bills died in committee, and another was vetoed by Gov. Jerry Brown. But Wiener continues to push the effort.

“California’s century-old, rigid 2 a.m. closing time, which applies equally in large urban areas and small farm towns, stifles our nighttime economy,” Wiener said earlier this year. “We should embrace nightlife and give local communities the ability to tailor their nightlife to their own needs.”

But Los Angeles Councilman Paul Koretz said the bill would put people in danger, and he authored the resolution to oppose the state bill.

“If this passes, we expect more assaults, more DUIs, more injuries and more death,” he said during a morning rally outside City Hall.

Koretz’s resolution passed 10-2 — councilmen David Ryu and Joe Buscaino voted against the resolution.

“”I think we would have that opportunity locally to figure out whether this is a bill that would help or hurt,” Ryu said. “I think this gives us more local control. I want to see how to use this bill to make sure … our streets are more safe.”

Koretz reiterated the results of a report released in July by the Alcohol Research Group and Public Health Institute that found if 5% the city’s bars stayed open until 4 a.m., it would cost Los Angeles $50.2 million annually due to public safety needs and other social burdens. It estimated the cost could rise into the billions if 20 percent of the market participated over five years.

According to a legislative analysis of the bill, it would cost the state at least $2-$3 million just to implement the program, along with a $500,000 allocation for the California Highway Patrol during the first year. But net revenue statewide from excise taxes could be about $1.6-$3 million annually during the pilot phase, according to the analysis.

The bill is slated to be heard once again in the Assembly Appropriations Committee, and Friday is the last day the bill can be heard.

Successful Aging: I’m over 80 years old and concerned about falling. What should I do?

Q. I recently hurt my back and am unsteady on my feet. My husband continues to work away from the house, as do I when I can. I am concerned about needing help if I fall and no one is here to help. How do you know if you are ready for an emergency response device? And how do you go about selecting one? P.S. I am in my early 80’s. S.M.

Dear S.M.

If you have concerns about falling and there is no one to answer your call for help, you might seriously consider an emergency response device.

The second part of your question has a longer answer.

Fortunately, there are a range of services and products that enable many older adults to live safely at home. One tool is a Person Emergency Response System (PERS), also called a medical alert system. With the aging population and the desire for independence, these products are becoming increasingly popular. They are not just for older adults. Those recovering from surgery, having balance and gait problems and facing certain health conditions find this tool useful.

What is PERS? It is an electronic device designed to let you call in an emergency situation by pushing a button. It has three parts: a small radio transmitter, a console connected to your telephone and an emergency response center that monitors your calls. If you fall when you are alone and cannot reach your phone to call for help, you press a button located on a device you carry or wear around your neck or wrist, or on a belt or in your pocket. Pressing the button alerts the central call center that you are having a problem. The Center will try to reach you by phone immediately. If you do not answer the phone, the call center will try to reach a designated person such as a family member or friend. If it is a medical emergency, an ambulance will be dispatched. Here are some questions to address in selecting a system as suggested by AARP.

What system will meet your needs? Although you may primarily be interested in calling for help for falls or emergency services, a PERS can do much more. It can serve as a medical monitor that includes medication reminders and monitoring health vitals. Systems also include monitoring of activity with motion detectors, fitness tracking and more.

What is the best type of equipment for you? Check if it is waterproof. This is important because many accidents occur in the bathroom. Determine the distance the device will operate from the base. If you are working in the yard, will it work? Does it include a GPS so the device is with you wherever you go? Does it connect to a smartphone or blue tooth? Check the battery life and technology updates.

What’s involved in setting it up? Given the size of your home, will you need more than one base unit to cover your entire home and yard? Does it sit on a table or should it be mounted to a wall? Does it require batteries or an electrical connection? What phone service is required –cellular, landline or both?

Here are a few additional questions suggested by the Federal Trade Commission.

Is the monitoring center accessible 24 hours a day/seven days a week?

What is the average response time?

Who are the people that get alerted?

What are the installation and monitoring fees?

What is the repair policy and what happens if I need a replacement?

Will the system work in another location?

What kind of training do you provide for your staff?

Do I have to sign a contract?

AARP suggests some answers to these questions which you can use as a benchmark. The response time should be a matter of seconds. A live person should be available 24/7. Beware of complicated pricing and hidden fees. The company should have no extra fees related to equipment, activation, service or repairs. Also, you should not have to enter into a long-term contract. Ongoing monthly fees should range between $25 and $45 a month. Note: some companies charge a flat yearly rate. Be cautious about paying in advance and check for discounts. Unfortunately, in most cases, Medicare, Medicaid and private insurance companies do not cover the cost.

Finally, do an online search and ask friends and family if they have any recommendations.

101 Freeway Shut Down Tuesday Night After Man Fatally Struck By Vehicle

HOLLYWOOD (CBSLA) — Police activity on the 101 Freeway Tuesday night shut down all lanes of the busy highway at Santa Monica in Hollywood.

Police said they received a call of a possibly intoxicated man at the entrance of the southbound 101 Freeway at Santa Monica. At some point after officers arrived, police said the man jumped onto the freeway where he was fatally struck by a vehicle.

Santa Monica Boulevard remained closed Tuesday night, while some lanes of the highway began to reopen after 10 p.m.

Both California Highway Patrol and the Los Angeles Police Department were investigating.

Bidding starts at 8 a.m., closing in batches starting at 1 p.m.

You must register to view the entire listing by clicking on the word “Register” in the blue banner at the top of the page.

To bid, you must submit a refundable $1,000 deposit by eCheck through the “My Payments” link on the registration website by 5 p.m. Sept. 10.

The treasurer’s office did not provide any further details on individual time-shares or give the dates when owners will have access to their properties. Specific questions should be directed to the resorts, the treasurer’s office said.

Treasurer-Tax Collector Shari Freidenrich warned potential bidders before prior auctions to research the time-shares thoroughly before bidding, saying they were being sold on a “buyer beware” basis.

Caught On Camera: Driver Of Mercedes Repeatedly Rams Into Car That Blocked Her In Hollywood Parking Lot

HOLLYWOOD (CBSLA) — The driver of a Mercedes was caught on video ramming her vehicle into a Ford Mustang that blocked her in a Hollywood parking lot.

The incident happened around 3 a.m. Sunday when 24-year-old Amber Rose Darbinyan, identified as the driver of the Mercedes, was behind the wheel of her Mercedes trying to leave after eating tacos from a Hollywood taco truck. It was then that the video shows her talking with the group of people behind her vehicle.

The video shows the confrontation escalating as plates and food begin flying and others in the group can be seen holding people back.

The group does not move, and Darbinyan can be seen in her vehicle ramming into the Mustang behind her multiple times until that vehicle is in the middle of traffic, and she is able to exit the parking lot. The video shows her almost hitting people in the process.

“We were like, ‘Wow, this is crazy,'” Juan Munoz, co-owner of Sugar Coat Innovations, said. “We’ve never seen anything that that happen in our parking lot at all.”

Darbinyan allegedly streamed a high speed chase on Instagram in 2018.

Darbinyan’s attorney said he is working with detectives for her to surrender. She is facing charges of vandalism and misdemeanor battery, but her attorney said there was more to the story and that he hoped to share more details and more video.

Police Investigate Possible Swatting Call At Winnetka Home

WINNETKA (CBSLA) — Police were investigating a possible swatting call at a home Tuesday night in the 8100 block of Oso Avenue in Winnetka.

The Los Angeles Fire Department responded to a call around 8:30 p.m. of a shooting inside the home. A fire engine was on the scene and an ambulance was heading to the scene after getting calls of a person shot.

According to initial reports, the family later called police to say that there was nothing of the sort happening in the home and that nobody from the home made the call.

The family was evacuated from the home, and police searched the two-story home.

“It was a fake call,” said a man who lives in the house. “They got inside my house, and they checked. And it’s clear.”

The family was able to return back to their home shortly after being evacuated.

Police are investigating the incident as a possible swatting call.

COSTA MESA (CBSLA) — When “Charlie and the Chocolate Factory” played at Segerstrom Hall this summer, 18-year-old Logan Mundt was ready to see his favorite show live on stage.

For the June 8 show, Mundt’s mom Francine made sure her son had his earphones and blanket and knew the schedule of the day. The Huntington Beach mom bought three tickets so Logan would have plenty of room, but he wanted to sit lower on the section in an area that had some vacant seats.

“I had the ushers come over to me and they said, ‘We can’t have him moving around during the show,'” Francine said.

She said she explained to the ushers that her son has autism and that bringing him back to their original trio of seats would create more of a disturbance. She asked the ushers if it was possible to let her son sit in the seat he chose for the remainder of the show since there were not many people there for the show that day.

“They understood, and it was great,” she said.

A few days later, Logan told his mother he wanted to go see the show again, so she bought tickets for her son and his care provider. Patrons complained that Logan was disrupting the show, and Francine said this time the ushers told Logan he had to leave — before the first act finished — and locked him out of the theater.

“He was in full meltdown mode,” Francine said. “So if you can imagine, a 6-foot-4 man standing outside crying and screaming.”

The single mom said she wasn’t angry at Segerstrom, but that she wants better sensitivity training for people who work in public places. And, she said, this training shouldn’t be focused solely on children with autism, but also for working with adults with autism.

In a statement about the incident, the theater said it was continuing its work to make the theater a more inclusive place for all patrons, and said that it encourages patrons to contact the theater in advance with any requests or concerns.

Francine has started a business that consults with organizations on how they can better address the needs and concerns of those with autism. She said that, if asked, she would absolutely work with the theater on developing this training for its staff — for free.

New Report Reveals Most And Least Valuable College Degrees

LOS ANGELES (CBSLA) — As college students across the country are heading back to school, a new report reveals which college majors lead to the most jobs.

Bankrate has released its annual report that shows the most and least valuable college majors.

The study ranked 162 majors and looked at factors like median annual income, unemployment rates, and the need for advanced degrees.

Topping the list was Naval Architecture and Marine Engineering degrees earning around $90,000 annually with an unemployment rate of 1.6%.

Overall, science, technology, engineering, and mathematics degrees dominated the top of the list.

The least valuable majors were all art degrees including fine arts, linguistics, drama, and theater.

People with a drama and theater arts degree earned about $36,000 annually.

23-Year-Old Arrested In Boyle Heights Hit-And-Run That Left Bicyclist Severely Injured

BOYLE HEIGHTS (CBSLA) — Police arrested a 23-year-old man Tuesday in connection with a hit-and-run collision in Boyle Heights that left a bicyclist severely injured.

Tips from the public led to the arrest Tuesday of Luis Raya-Flores who allegedly struck and injured a bicyclist in Boyle Heights and fled the scene.

Hours before his arrest, a $25,000 reward was offered for information regarding the crash that was caught on video.

The crash happened Thursday at about 10:20 p.m. A man on his bicycle was riding east on Whittier Boulevard near Calzona street when a white pickup truck crossed the center divider into oncoming traffic and hit the bicyclist head-on, according to Los Angeles police.

Video shows the impact of the crash threw the bicyclist into the air and flipped him before he came back down onto the truck’s hood and onto the ground.

After the crash, the truck was seen veering back onto the right side of the street. Police say Raya-Flores did not stop to help the bicyclist and fled the scene in the truck.

“After the collision, the driver failed to stop to render aid, identify himself or herself and fled the scene in the vehicle,” according to an LAPD statement.

Raya-Flores knew why Los Angeles Police Department Detective Juan Campos turned up at his Canoga Park area home and admitted to being the driver, Detective Campos said.

According to Campos, Raya-Flores said he fled because he panicked after hitting the bicyclist.

Raya-Flores was arrested on suspicion of felony hit-and-run and was being held in lieu of $80,000 bail.

The bicyclist, a 53-year-old man whose name was withheld, was taken to a hospital with severe injuries.

The victim was said to be doing well, recovering at home as of Tuesday afternon, police said.

Witnesses said the pickup truck was being driven at high speed and the driver lost control as he made a turn, leading to the collision, Campos said.

CSUF sports: Titan women defeat Gophers, 2-0, for first win of 2019

Junior Callie Petrey-Juarez and senior Maddie Bennett scored goals to lead the Cal State Fullerton women’s soccer team to its first win of the season Sunday as the Titans defeated the Minnesota Golden Gophers, 2-0.

Petrey-Juarez’s first goal of her career came at the 11:26 mark to give the Titans a 1-0 lead.

Senior Atlanta Primus delivered a through-ball to Bennett who made a strong run into the box and crossed the ball to the back post. Petrey-Juarez headed it home.

Bennett capitalized on a loose ball in the box to score her first-career goal to give the team the victory. She was dangerous all game in the attack as she had four shots, three of them were on target and the other was just wide.

The Titans return to action at 5 p.m. Friday against Northern Colorado in what will be a doubleheader with the men’s team.

In their first match of the season Aug. 22, the Titan women fell to Arizona State Sun Devils, 4-1.

Junior Haley Brown scored for the Titans.

While the game was scoreless at the half, the Titans had just missed on three great chances, two of which were strong saves from ASU goalkeeper Giulia Cascapera and the other was a shot just wide from junior Callie Petrey-Juarez.

The Sun Devils had just one shot in the first frame.

The game really opened up in the second 45 minutes as Sargeant Lorato scored at the 47:33 mark, collecting a loose ball and hitting right between the legs of redshirt freshman goalkeeper Noa Schumacher.

The Titans answered back at the 48:45 mark courtesy of a Brown header. Sophomore Kaya Hawkinson took the corner kick which senior Atlanta Primus deflected towards Brown who headed the ball just across the line before the ASU defender could clear it.

ASU then scored in the 53rd, 61st and 80th minutes to secure the victory.

The Titans were down to 10 players for roughly the last 20 minutes as Sam Blanchard was given a straight red card.

Men’s squad will face Hartford

The men’s soccer team will be play Hartford at 7:30 p.m. Friday at Titan Stadium in the squad’s season opener and doubleheader with the women’s team.

The Titan men’s squad was picked to finish fifth in a recently released Big West Conference Preseason Coaches Poll while goalkeeper Paul-Andre Guerin was named to the preseason all-conference team.

The Titans received a total of 36 points with one first-place vote to place them fifth.

UC Santa Barbara garnered 53 points with three first-place votes, UC Irvine tallied 51 points with two first-place votes, CSUN received 45 points with no first-place votes and UC Davis earned 39 points.

Guerin earned his first preseason all-conference nod after starting in 20 out of 21 games in 2018 while racking up six shutout victories. The senior currently ranks fourth in career shutouts in the history of the program with 15 and needs just five more in 2019 to hold the record. Guerin is the Big West Conference active leader in saves (156), shutouts (15) and minutes played (4488).

Men’s basketball schedule announced

The Cal State Fullerton men’s basketball team has released the 2019-20 season schedule: a 31-game slate with 14 home games.

The Titans will play in their annual Blue/Orange Scrimmage on Oct. 16. Then they’ll have one more preseason game as they host Cal State Dominguez Hills for an exhibition game on Oct.31 in Titan Gym.

The season opener Nov. 5 against BYU will be the start of a three-game road trip. Next, the squad heads to Stanford for a PAC-12 matchup on Saturday, Nov. 9. Then on to Wyoming for a game against the Cowboys on Nov. 13.

The Titans will play their home opener Nov. 16, against Stanislaus State and then Hofstra the following weekend on Nov. 24, in Titan Gym.

Volleyball squad beats UCSD

In an exhibition match Saturday, the CSUF volleyball team dropped the first set but bounced back to take three straight to top UC San Diego, 13-25, 25-19, 25-19, 26-24.

Julia Crawford led the way, recording a double-double with a game-high 19 kills to go along with 11 digs.

Savahna Costello came up with a game-high 24 digs while Elizabeth Schuster posted a team-high 27 assists.

Haley Carmo had a productive match finishing second on the team with eight kills at a 33.3% clip to go along with a game-high five blocks.

Fullerton bounced back from their first set loss to take set number two, 25-19 thanks to a huge improvement in their kill percentage finishing at 25.7% on 35 attempts after just a 16.2% mark in the first set.

They kept it rolling into third set coming out with another 25-19 victory. Crawford led the way with her best set of the game coming through with seven kills on 17 attempts.

The Tritons came into the fourth set and had the advantage for almost the whole set leading by as many as five at 19-14 before Fullerton rallied back. A 10-4 run by the Titans would set up match point and eventually lead to a 26-24 set victory to give the Titans the set and the match.

The Titan women kick off their 2019 season Friday with a pair of games at the Idaho Volleyball Classic. The first of those games will be against Eastern Washington at 11:30 a.m.

Page joins women’s basketball coaching team

Jodi Page has joined Cal State Fullerton women’s basketball as an assistant coach heading into the 2019-20 season. She will be in charge of instructing the guards as well as helping with recruiting.

“Really happy to have found a quality coach and person like Jodi at this time of the year,” said head coach Jeff Harada.

“I could see her passion for coaching during the interview process, and everyone felt her positive energy during her interactions on campus. She has some big shoes to fill but is a perfect fit with her experience at Eastern Washington and in Australia which will definitely benefit our program. We are more than excited to welcome her to the Titan family!”

Page brings more than 25 years of basketball experience as both a player and a coach to the Titans women’s basketball program.

Her most recent experience was as the assistant director of operations for Arizona State’s women’s basketball program. Her responsibilities at ASU included recruiting, general administration, scouting, co-coordinating all aspects of team travel and organizing training table and team meals.

Before her Arizona stint, she was at Eastern Washington University where she served as an assistant coach for three seasons. In her role at EWU, Page was in charge of instructing the guards in addition to preparing and presenting scouting reports and facilitating the program’s day-to-day operations.

Spider-Man Looks Set To Exit the Marvel Cinematic Universe

A dispute over producing rights and revenue sharing appears to have done what several supervillains couldn’t: knock out Spider-Man. The wallcrawler had gotten a new lease on life in the Marvel Cinematic Universe, where he has helmed two standalone movies and appeared as a prominent character in three others. But Disney and Sony could not reach an agreement to continue their partnership, so he’s swinging back to Sony exclusively.

Ahead of D23 — the annual event where Disney outlines its movie, parks, and new streaming plans — news broke that Sony and Disney were unable to reach an agreement to renew the deal allowing Spider-Man into the MCU, and that Marvel Studios president Kevin Feige would no longer serve as a producer on the Spider-Man films. Sony initially said the reports had been mischaracterized, and stated it was “disappointed” in the dispute. 

At first it appeared the discussions may be ongoing, but soon after Feige began talking about the agreement in past-tense, signaling it was over. 

“I’m feeling about Spider-Man gratitude and joy,” Feige told Entertainment Weekly. “We got to make five films within the MCU with Spider-Man: two standalone films and three with the Avengers. It was a dream that I never thought would happen. It was never meant to last forever. We knew there was a finite amount of time that we’d be able to do this, and we told the story we wanted to tell, and I’ll always be thankful for that.”

The partnership began in 2015, allowing Marvel to use Spider-Man in the Marvel Cinematic Universe films, while Sony retained the film rights to the character. Sony secured the film rights to Spider-Man long before Marvel was acquired by Disney and began making its own movies under the Marvel Studios label. Sony was responsible for the Sam Raimi trilogy of films, which starred Tobey Maguire as the iconic supehero. The movies were rebooted with Andrew Garfield as the web-head, but the uneven performance of those films left the character in creative limbo. 

The agreement to allow Spider-Man into the MCU was mutually beneficial. It allowed Marvel to use the popular character while letting Sony benefit from having him as part of the Marvel juggernaut. The exact terms of the deal were never disclosed, but the renewal reportedly fell apart over the revenue split.

What’s next for Spider-Man movies?

This breakup comes on the heels of a major plot twist for the character. In “Spider-Man: Far From Home,” which served as a postscript for the universe-shattering events of the last two Avengers films, the web-slinger had his world turned upside-down. In a post-credits sequence, J.K. Simmons reprised his role as the muckraker J. Jonah Jameson, and revealed Spider-Man’s secret identity to the world. 

That wild left turn, paired with fake news regarding his involvement in the death of a purported hero, could make Peter Parker public enemy number one. 

When the deal collapsed, fans wondered if this meant Sony would reboot the character altogether. That doesn’t appear to be the case. ComicBook reports that Actor Tom Holland said he’ll still be playing the character, and added that the next movie will be “very different.” That may mean the character will pick up right where Far From Home left off, albeit without the references to the larger Marvel universe. 

Can Disney and Sony still make a deal?

It is still possible that Sony and Disney could renegotiate their terms. It wouldn’t be the first time Disney appeared to cut ties and later changed course. Director James Gunn was fired in 2018 from Guardians of the Galaxy 3, the third installment in a series he helped popularize. Disney appeared steadfast in the face of fan petitions and even cast members speaking out, but the tides slowly changed. Earlier this year, the company announced it would reinstate Gunn as the director of Guardians 3. 

Spider-Man is one of Marvel’s most popular characters and the deal to bring him into the MCU was an important one. For now, Marvel appears to be moving forward with its Phase 4 plans without the character, but that may change. 

Meanwhile, Sony is moving forward with its own films based on Spider-Man characters, including a sequel to “Venom,” a sequel to the animated “Into The Spider-Verse”, and a movie based on the vampiric antihero Morbius.

Hot Spot Flares Up In Eagle Rock Fire; 2 Freeway Transition Road Still Closed

EAGLE ROCK (CBSLA) — Firefighters worked to contain a flare-up Monday in a brush fire that broke out over the weekend along the 134 Freeway.

The fire initially broke out Sunday afternoon and burned dangerously close to a Glendale neighborhood, prompting the evacuation of 100 homes. The mandatory evacuation orders were lifted by 10 p.m.

Firefighters battled the blaze from the air aggressively, making water drops into the night. No homes were burned and no injuries were reported. As of Monday afternoon, the blaze was more than 50 percent contained.

The fire also shut down the 134 Freeway, the 2 Freeway and the Angeles Crest Highway at the 210 Freeway as the firefight reached a fever pitch, wreaking havoc on Sunday afternoon traffic throughout the area. The 134 Freeway was reopened by Monday morning.

Firefighters conducted water drops on the area Monday afternoon after a hot spot flared up near the top of the hill.

7 Survive Fiery Plane Crash At Santa Barbara Airport

SANTA BARBARA (CBSLA) – Seven people escaped without major injuries after a transport plane crashed and caught fire at Santa Barbara Airport Sunday night.

The private Lockheed C-130 plane was making an emergency landing when it skidded off the runway and caught fire at 10:13 p.m., according to a Santa Barbara County Fire Department spokesperson Mike Eliason.

None of the seven people aboard were seriously hurt.

The plane, bound from Hawaii that morning, had briefly stopped at the Santa Maria Airport, which is about 65 miles north of the Santa Barbara Airport.

Shortly after takeoff from Santa Maria, the C-130 experienced problems and was forced to make the emergency landing at Santa Barbara Airport. The Federal Aviation Administration told CBS News the plane experienced hydraulic problems.

As a result of the crash, all flights in and out of Santa Barbara were canceled into Monday morning. The airport reopened just after 5 p.m.

The plane is owned by a company called International Air Response, according to CBS News. It’s unclear where it was headed when it crashed.

The FAA and National Transportation Safety Board is investigating.
